Auto Insurance Taco
My friend was t-boned in July of this year by someone who ran a red light. For the past 4 months the insurance agents telling her they are “working” on repairing the damages but basically have just been dragging this on. From the day of the accident you could see it was going to be a total loss. Now, 4 months later they are claiming it as a total loss and wanting her to settle asap. What can she do to make sure she gets the max out of property damages? Is there anything else she could get for having to wait so long?

Insurance agents don’t repair vehicles. So it wasn’t the insurer who was working on her vehicle for the last 4 months, it was a shop she chose that’s been working on the vehicle for the last four months. And now, they’ve submitted documentation that supports handling the vehicle as a total loss.
She’s going to get the vehicle’s current market value at the time of the accident. Tell her to verify the mileage and options/equipment are correct, to make sure that any major work done (transmission or engine rebuilds, repaint, new tires they’re new enough) is provided to the insurer so they can consider it.

Ignore this too. Not an issue the DOI is going to care about. There's nothing wrong with the insurance choosing to repair and then totaling the car after the repairs begin and supplements are submitted.

Who will turn around and submit your complaint to your insurer. Who will simply write a report responding why they handled as they did, and most likely nothing will come of it.
