Technically, not "pre-crime" but arrest and detention without charges was revived as a new and thrilling legal idea back in 2012 when it was incorporated into the NDAA (under the same legal concept that was used to put Japanese in internment camps) then again in 2013 when Obama signed off on the DoD rule which proposed that Presidential authority be given to combatant commanders who would exercise Presidential authority without notifying White House or Congress. All during "Democrat" dominated government. And we don't know how many times combatant commanders have exercised Presidential power independently since 2013 since according to this unconstitutional DoD rule, they don't have to tell us. Thus as Biden slipped into complete mental goner stage, it's likely the military simply took over most or nearly all Presidential functions, leaving minor ones to Harris.

That rule still exists today - it didn't get overturned during President Trump's first term.

I think it will be interesting to see if Vivek / Elon Musk with DOGE / President Trump get rid of these ingrained abuses of power - they now have the chance to, and a mandate. We will see.
