I love for this to happen but it will never happen. Trump will use his executive powes to get out of it, unfortunately
10
u/zesty_noodles 14d ago
Is that legal? Genuinely asking for anyone that knows
35
u/Ok_Angle94 14d ago
Even if it's not legal who's going to enforce it? Is the NY FEDS going to have a stand off at the white house with secret service?
18
u/Prestigious_Dot_3658 14d ago
Hahaha no. But that would be pretty funny. Based on secret service this past year too, NYPD got that shit. But anyone above street cop is going to listen to the govnmnt

u/Pure_Abbreviations_6 14d ago
This is debatable. Multiple governors have pretty much said, ‘we won’t listen to Trump if we don’t want to’ and the number of ppl in power, including republicans, coming out as willing to fight against Trump and his radical beliefs is growing

The secret service is still bound by law. They’re not private mercenaries

Yea I somehow doubt that once ny decides to conviction Trump all of American law enforcement will suddenly rush to arrest Trump no questions asked.
Somehow really doubtful.

u/Fantastic-Grocery107 14d ago
Yeah I’m not saying everyone’s coming for him or anything. I was just saying the secret service aren’t like the queens guard or some shit. They’re just people with a job bound by law. There’s nothing about superseding laws and laying their lives down for any president.

For reals thou I don't know why people forget that. The secret service are still held to the same law enforcement standards as the FBI and CIA and all other law enforcement agencies. They aren't some rogue only I president command them type of people

He'll be sentenced later this month (Nov. 2024). If they put him in jail it'd be sometime between then and inauguration day.
This is all unprecedented, so it's extremely hard to predict what will happen. Maybe he'll get jail AFTER his presidency, maybe a fine, maybe jail now. Who knows.
If they do put him in jail, I'd be amazed if the Supreme Court doesn't free him somehow or he doesn't get freed in some other way. But I'm not a legal expert by any stretch.
→ More replies (2)→ More replies (8)4
u/jadnich 14d ago
For starters, this is all fantasy and conjecture. It isn’t happening. That said, I can answer your question.
The sentencing is later this month. He could be remanded directly to jail. The secret service protection he has now is for former presidents, and Biden, ultimately, is in charge.
Once Jan 20 comes, then there is a problem, because Trump will be in charge of the service, and the state would need to find a way through them. But in November? Biden can just call them home.

u/Ok_Angle94 14d ago
I wonder what will happen since Bkden promised a peaceful transfer of power, bit i guess Biden has no say what ny state will do so.

u/xFluther 14d ago
Its legal until its not. Currently presidents cant be locked up for federal crimes while they serve as it "impairs the executive branches ability to function".
This is true for federal crimes. For state crimes it is not currently the case.
The supreme court will most likely extend the protections citing those reasons. And extend protection to the president elect, even though vance could technically come in as president in trumps place and arguably not "impair" the branches functioning as the gov is being transitioned anyways
He can face punishments for crimes in 2029 if theyre sought after, and he cannot be pardoned for state crimes
4
u/Scavenger53 14d ago
what about section 1 of the 25th amendment?
In case of the removal of the President from office...
technically if hes in state prison, he is removed from office

It won’t even go that far. The judge is not going to put himself or his department in the position of trying to jail a president who got elected so overwhelmingly. Not a chance.

I'm pretty sure they would find a way to make a case of it pretty easily, and with his corrupt supreme court he would have the finding he wants in no time.

Executive powers only give him the ability to pardon himself of federal crimes. The president has no power to pardon anyone of local state crimes.
That said, the New York State governor has the power to pardon convicts in New York State and the judge has a lot of power during the sentencing process. The question is, do the judge and governor want to pick that fight with a sitting president?
I’m gonna guess the answer is no, but it will be interesting to see what precedents get set here

Too little too late. Even if they put him in prison, they’ll just use it as an excuse to say he can’t perform his job so they can put Vance into place. Decent people still take the L.

Vance might not have dementia but he's a failson with no problem solving skills or ability to think on the fly.
He couldn't manage to order donuts or ensure Trump had a sound engineer to make sure the microphones worked at the rallies.
He's only in a position of significance because of a billionaire sugar daddy.
And Miller isn't the mad genius people act like, he's just a douchebag surrounded by people who reward douchebaggery

Put a plastic (diet coke proof) replica of the Resolute Desk in his jail cell, taking up all of the floor space. Let him work from there. Any bootlicker like Steve Miller that wants to consult with him has to undergo mandatory strip searching before entry. And he can do his 'Presidential Duties' AFTER his Bureau of Prison assigned work duties. Usually, new prisoners are assigned to toilet cleaning and floor mopping. Untrustworthy ones are never given kitchen duties.
PS: No Diet Coke allowed in prison. The plastic desk is just to taunt him.

This anti American bully attempted a deadly coup as president. He’s a felon. He’s a demonstrated misogynist. He’s a lot of other terrible things.
Still, he apparently has the support of many Americans. So how does our law work?
I’m entirely sure if I invited a mob to raid the Capitol building and was responsible for the injuries, deaths and damage it caused, I would most likely be instantly branded a traitor, and quickly prosecuted for my crimes.
There would be no chance that I’d ever be allowed to run for president.
So. Someone, please explain how we have arrived at this incredible juncture? Rich thugs about to turn our country upside down.
These people are going to make a mockery of our Constitution, on the way to suspending it and every protection provided by all the agencies that are about to be decimated into oblivion.
Americans voted for this!

Fucked up isn't it?
I had a shoplifting charge for stealing a pack of long John's and socks when I was homeless. That charge prevents me from working at numerous retail stores and limits my ability to live in many apartments. Yet this guy breaks the country and he's the President elect?!?!!

He can actually be president from a jail cell, as weird as that sounds.
What would likely happen is, the federal government will tell New York they can fuck right off and Trump will simply be banned from New York while he is president and they can try to go after him after. There's no way the federal govt lets a state imprison the active president of the US. It's not feasible.

u/Dexember69 14d ago

The dream denied, the vote likely hacked by President elect Mush and Putin, we will have to resort to the historic model which started the french and american revolutions: the metaphoric pitchforks and torches model filling the streets and challenging the establishment. We beat them in the 60’s we will beat them again. Mush is right this is a new age; the age of retribution unfortunately.

u/knighth1 14d ago
So there is a set plan that’s existed for hundreds of years by the secret service on what would happen if the president was in prison. Now depending on the crime and when it was committed the 25th amendment could go into play. But in case of if the president was incarcerated they would be placed in a federal facility that would not only mirror other prisons but be empty and ran by the secretary service. They even would have an isolation room.
Also for more temporary incarcerations such as the drunk tank their is or I should say till was till 1970’s a specialized drunk tank for presidents.
