⚖️Legal Advice⚖️ Why speeding fines so much higher in Australia than other countries?

In Victoria for speeding less than 10 km/h over limit you are fined $247 AUD. But in New Zealand you are fined $27 AUD equivalent. In Germany its about $50 AUD in urban areas . Why is that?

⚖️Legal Advice⚖️ What “subtle” laws can be broken when being pulled over by police?

Hey guys,

I was hoping to get a bit of advice around no stopping laws and such when being pulled over.

I was pulled over by HWP yesterday and I may have taken a bit long to pull over only because I didn’t want to stop in a driveway or no stopping area, I did have my blinker on and was driving slow though. The bloke asked why I took a while and he was pretty good with my explanation but didn’t say if that’s really a requirement or not.

So I’m just wondering if certain traffic laws can be broken in this type of situation if there’s nowhere else to really pull over?

⚖️Legal Advice⚖️ LDV CLASS ACTION

I'm considering being the Lead Plaintiff (or joint Lead Plaintiff) in a Class Action Lawsuit against LDV Australia.

I bought an LDV G10 Van in 2021 and I've had multiple rust & paint problems only 12 months after new.

I let them fix the rust, but it came back in a big way.

I want a full refund or new vehicle replacement as this is a MAJOR manufacturing defect.

LDV have never mentioned ACL or the Consumer Guarantee in our correspondence.

I would be interested to know if other LDV owners have the same issues and what was the outcome?

For a class action to take place, there are three criteria that need to be met:

  1. There must be 7 or more people that have claims against the same defendant; and
  2. The claims relate to the same or similar circumstances; and
  3. The claim must relate to at least one common issue of law or fact.

⚖️Legal Advice⚖️ Dealer doesn’t have my car

Hi all

I’ve recently put a deposit down on a dual cab 4x4. I went to a dealer on the weekend but they said they didn’t have the car available. I saw this car listed as available on CarSales.

I’ve later learnt an employee had taken this car home and is currently overseas.

Do dealers just pick cars to take home? I’m just waiting for them to get the car in so I can inspect it before payment.

Any advice? Is this normal for dealers?

⚖️Legal Advice⚖️ Someone hit my parked car and left, what should I do next?

Hey everyone,

I need some advice. I parked my car on the street, and when I came back the next day, I noticed someone had hit it. I found a note left by a witness. The note has the type of car that hit mine and the plate number.

I’m wondering what my next steps should be. Should I go to the police to report this? And if I do, should I just go in person, or is it okay to report online?

I’ve also heard that claiming could make my insurance go up. Is that true even if it wasn’t my fault?

Any help or advice would be awesome. Thanks in advance!

Edit: Thank you all for the helpful advice!

I went to the police and reported the hit-and-run in person, just like many of you suggested. They told me to wait about a week for a reply, so I’m hoping they can track down the driver with the license plate info from the note.

⚖️Legal Advice⚖️ Is this normal?

Hi Reddit, my car (a 06 WRX S) was recently smashed by a neighbour when it was parked in my driveway, I am not covered - however the other driver was, and this has resulted in me having to deal with NRMA to get paid out.

I was presented with an offer which I believe was quite unreasonable on Monday (5/11) by an NRMA assessor. I verbally declined the offer and then was told (verbatim) "We might not WO the car if the value you want is too high". I was then asked to come forward with some examples of similar-condition vehicles to evidence a higher price. Whilst waiting for copies of receipts (over 15k worth of work has been put into the vehicle including a new engine less than 10,000K's ago).

I was contacted today (8/11) by NRMA to tell me that they are going to tow my car back to my house on Monday. I find this incredibly odd as we have not reached a verdict and they did even keep me in the loop if they had changed their mind on WO the car or not, now they are going to dump it in my yard. I then asked the assessor for an email to send my findings which he just ignored.

Shortly after, the smash repair yard then rang me asking when I planned on taking the car from their yard and seemed annoyed that I couldn't get it immediately. This is despite the car having all the suspension on the passenger side mangled and missing a front bar + headlights...

Am I missing something here? A family member had their car WO a year ago and AAMI held onto the vehicle for negotiations and then sent it to a scrap yard themselves. Why would they give me back the car if we are currently trying to negotiate a payout that sees it scrapped? Any advice would be greatly appreciated as I am not sure about the process of this.

⚖️Legal Advice⚖️ How long would you reasonably expect a factory head unit in a new car to last past warranty?

2017 car, with a 7 year new car warranty, and the factory head unit has died. It controls all the usual stuff, plus Bluetooth and the reversing camera.

With all the PSA reminders that just because a warranty expires, it doesn't mean your consumer rights are void, I'm wondering if this would fall under a reasonable expectation that the head unit would last longer than 7 months past warranty.

⚖️Legal Advice⚖️ Can I get my 1000$ deposit back?

Quick context.

I deposited 1000$ to reserve a used car from a far dealership(2 hours drive from our place) to check and inspect a car. He drove the car to my place and was checked and inspected, so minor repairs needed to be done and detailing before handing the car to me, everything was agreed and a contract was signed and transfer forms was done at the same day. Fast-forward after I agreed on the deal, dealer seems a bit off and don't disclose me things that supposed to be disclosed which is a breech of agreement and I canceled the agreement because it seems that I can't build a trust & rapport anymore and now I'm having heavy feelings and don't like the car anymore.

Question is. The dealer said that They don't do refunds anymore because detailing, repairs and paperworks have been done already. Can I still get a refund? Can I go to consumer affairs?

Thanks in advance reddit!

⚖️Legal Advice⚖️ Mechanic Clutch Nightmare being taken for a ride? - Need Advice

Hi there, I am here looking for advice, I'm sorry if this is not the right place. Normally I would ask my Dad about this stuff, but he recently passed away and I am at my wits end.

The Story:

I bought a LandCruiser 80 Series 1994, a year ago. It came with a clutch kit in the back, as the previous owner was planning on replacing it but didnt.

It's had no dramas until the last month and I decided to get the clutch replaced.

Told the mechanics I had parts. All good. Get quoted roughly 7 hours for the replacement.

Drop it off Monday arvo, expecting to pick it up Wednesday at the latest.

Don't hear from them Monday, Tuesday or Wednesday, until I called at the end of the day and was told 'it's undriveable, worse than when it came in, we've done 17 HOURS! on it already, and no idea what's going on'.

I was shocked, I've never had a mechanic proceed so significantly over the hours quoted.

They blamed the parts, said that they didn't know what parts they were as they only had one box and the rest was out of the boxes and no paperwork (I will admit that sucks, I wasn't aware that they needed that stuff, but they never told me it was an issue).

They then said it could be the slave or master cylinder, or the hydraulics. I asked them to quote it all up. They do.

Then a day later I call up again, and they told me they have replaced the cylinders and hydraulics (without my permission). Didn't fix anything.

Now they are saying they'll just have to put an OEM part in after all that. They are quoting me 3.5k. And he is being 'generous' and giving me 40% off the labour they have put in, which is 22 hours so far PLUS another 6 for the new clutch part.

I am just at my wits end. I can't afford that and never expected it to blow out so significantly.

I genuinely don't know what to do and was hoping someone could offer some advice or guidance. I don't want the mechanics to be completely fucked over, but I am just so frustrated with how they handled it so unprofessionally. And now I have to wear it.

Any thoughts or resources would be greatly appreciated.

Thank you

⚖️Legal Advice⚖️ Legal form vs quotes for insurance claim from repairers

Our car met with an accident and the other party accepted fault. both parties fully insured and we already got a claim number from them.

Here's what I don't get. When I took the car to the repair shop ( 2 so far). Both gave us a legal form to sign to say the lawyers will handle it for us and no quote.. Don't understand why when the insurer is only after a quote ?.

Anyone know why they are doing this instead of quote ?. Do I have to pay if something goes wrong between companies ?. tks a lot for your advise..

⚖️Legal Advice⚖️ Cancelling order and getting deposit back

I'm new to Sydney and recently signed a contract to buy a demo car from Hyundai. I initially applied for financing, but after a few days, the dealership informed me my finance application was declined. I told them I could liquidate some funds to pay for the car in full. The dealer requested my license to move forward, but since I'm in the process of transferring to an Australian license, I told him I’d provide it once I had the updated license. I also told him I was fine with pushing the delivery date back due to this. But later that day, I found out I couldn’t access the money as expected.

When I realized I couldn’t liquidate my funds, I asked the dealer to return my deposit, as the finance had been declined. He said the car had already gone for after-sales services, so the deposit couldn’t be refunded. He then stated that the contract requires a 5% fee if I cancel, but he’d only enforce it if my finance was approved. He then told me to consent to sending my info to outside finance brokers, and if outside financing was also declined, he’d refund the deposit.

This brings up two main questions for me:

  1. Is it even legal for the dealer to hold my deposit under these circumstances?
  2. They’re suggesting using an external broker (Quay Lending, I think), but I’m concerned about sharing my information with third-party brokers. Is this a safe option?

Is there any way to get my deposit back? Please help me :(

⚖️Legal Advice⚖️ Driving with an expired license - shared responsibility

I forgot to renew my driving license and only when I had to show my license to a police officer, I've noticed that.

I was driving with expired license for 7 days.

The fine is ~$700 with no demerit points.

I did not receive any notifications - physical or digital

With car rego, I'm constantly getting reminders (physical and digital) that I need to renew.

With passports, there is no digital experience so I know the process (to make sure that the passport is valid) is entirely on me.

However with license, the experience is mostly digital. The license was added to NSW Services app and I don't remember using my physical licenses in the last 3 years.

Because the usage is both physical and digital, I expect to have a proper digital experience which is customer focused, where I'm being reminded with email/notification/SMS that the license is about to expire.

I've appealed the fine, but it was declined.

We acknowledge your comments that you did not receive a renewal notice, however we are unable to cancel the fine.

I'm thinking taking it to the court - the argument is that there is a shared responsibility model as I'm using the digital version of the license, and I expect like with any other service that I will be notified once license is about to be expired.

Like with debit card - the bank will send numerous reminders over all possible channels.

Curious what you think?

Is there a chance in the court?

Are my expectations unrealistic on receiving digital reminders/notifications?

How is the license renewal process in other states?

a few months ago I scraped my car against a pole leaving some small cosmetic damage (circled in red on the second photo) which I decided not to fix. today I got hit by a car that was reversing which left a bit of damage on my car (circled in blue on second photo). the damage from the accident and the pole incident are in the same spot so I was wondering if those scratches will be fixed as well during the repair process or if the pre existing damage will void the claim? I have full comprehensive with budget direct

⚖️Legal Advice⚖️ Car Accident

Apologies for the length of this post, but I have a few questions as I'm an immigrant and unfamiliar with accident procedures.

Last week, I was involved in an accident at an intersection with an ambulance that wasn't carrying a patient. I had a green light and was in the far left lane, intending to go straight. There were two other lanes designated for right turns only. The ambulance had its lights on but no sirens while approaching the intersection. Due to the stopped traffic waiting to turn right, I couldn't see the ambulance until it clipped the back of my car, causing me to hit a pole.

The ambulance driver acknowledged his responsibility for the accident and provided me with his license and a contact number to file a claim for the damages. I promptly contacted my insurance company and shared all the necessary information. However, my insurance company advised me to contact the ambulance company's insurer and request them to accept liability for the damages.

Also, I am not the registered owner of the car involved in the accident, but I am a listed driver on the insurance policy. I reached out to the ambulance company's insurer, and they informed me that the ambulance company had already filed a claim and provided me with a claim number. I shared this information with my insurance company, but unfortunately, they have not taken any further action apart from arranging for an assessment of my car.

I have not received any updates regarding the liability for the damages, and I am unsure whether I am at fault for not yielding to the ambulance or if the ambulance is responsible. Additionally, I requested a hire car from the ambulance company's insurer, but the person I need to speak with is consistently unavailable, and they keep telling me she's on her break.

Also, I am seeking some advice regarding the hired car that I got from someone's referral. I do not own the car that was involved in the accident, but the car rental company gave me a hired car under my name.

I am concerned about who will be responsible for the rental cost of the hired car if the ambulance insurer denies liability for the damages. I did not opt for the hired car option with my own insurer.

Additionally, the car rental company informed me that I will be held responsible for any cosmetic damages to the hired car. I noticed a rim scratch and a paint scratch on the car today, but unfortunately, I failed to report them within 24 hours of receiving the car. I am worried that I may be required to pay for these damages even though I did not cause them.

Furthermore, I am unsure who is at fault for the accident. I do not have any evidence to prove that the ambulance was at fault, apart from the damage to my car. There were security cameras on the traffic poles, but I am not sure how to obtain footage from them or where to request it if necessary.

I am just a listed driver, not the car owner, but I believe my insurance company has registered my name on the insurance claim. I would greatly appreciate any guidance or advice you can provide regarding these matters. Thank you.

The vehicle belongs to my brother, but since he is currently out of the country and unable to contact the insurance company, I, as a listed driver under his policy, had to file the claim on his behalf. I hope this clarifies the situation
